Burns and Disability Insurance
An individual who has been seriously burned might be able to receive disability insurance depending on the circumstances and the particular type of injuries and disabilities. The NJ disability lawyers at Kazmierczak & Kazmierczak devote themselves to protecting those with disabilities.
Types of Burns
There are three layers of your skin and four degrees of burns. The epidermis is the outer layer of your skin. When a burn only damages the epidermis, it is considered a first-degree burn. The layer of skin below the epidermis is the dermis. A second-degree burn occurs when the dermis and epidermis are damaged. The third and deepest layer of skin is the subcutaneous layer. A third-degree burn affects all three layers of the skin. A fourth-degree burn occurs when the damage goes beyond the three layers of skin and injures the muscles and tendons.
- First-degree burn: This is the most common burn and it usually is not serious. This type of burn causes redness to the skin. Sunburn is one example of a first-degree burn.
- Second-degree burn: This deeper burn usually involves blistering of the skin. This type of burn can be very painful depending on the amount of damage to the nerves.
- Third-degree burn: This type of burn results in extreme damage to the skin and may require grafting. Third-degree burns can cause permanent damage and scars, including loss of hair and pigmentation.
- Fourth-degree burn: In such cases, catastrophic damage to the skin occurs and the muscles, tendons and ligament tissues below the skin may also be injured. Grafting will be required if the burn is not fatal.
The Social Security Disability claim process
It helps to have a long term disability attorney assist you through what can be a complex and challenging process. Most claims are denied in the beginning. Less than half of all claims are actually accepted initially. If your claim is denied, you may want to think about disability reconsideration. After that process, if your claim is still being refused you can request a hearing. An administrative law judge will hear your case and utilize a vocational expert to determine what jobs you are able to perform.
The amount your benefits are worth depends on how much you earned or worked in the past. It may also change depending on your claim circumstances. How much a disabled child can earn depends on how much the parent earned and how much a disabled widow can earn depends on how much the spouse earned.
