NJ Skin Disorder Disability Lawyers

Dermatisis

When most people think of disabilities, they think of people in wheelchairs or people who are blind or deaf. The truth is that there is a wide array of disabilities. One commonly overlooked category of disability is skin disorders. In order to be considered for disability insurance, you must be able to prove that your disability greatly affects your ability to function normally. As your skin is your largest organ and it makes up 15 percent of your body weight, a serious skin disorder can clearly affect your ability to live a normal life. In fact, some skin disorders can be debilitating and as incapacitating as other major disabilities. The Social Security Administration recognizes this medical fact and has a list of skin disorders that qualify for benefits.

Types of skin disorders that may be considered a disability:

  • Dermatitis
  • Atopic dermatitis
  • Allergic contact dermatitis with skin lesions
  • Ichthyosis
  • Pemphigus
  • Epidermolysis bullosa
  • Bullous diseases
  • Erythema multiforme bullosum
  • Bullous pemphigoid
  • Extensive skin lesions from chronic skin infections
  • Dermatitis herpetiformis
  • Psoriasis
  • Exfoliative dermatitis
  • Hidradentitis suppurativa
  • Burns
  • Genetic Photosensitivity disorders
  • Xeroderma pigmentosum (if disabled from birth)

Dermatitis Herpetiformis

Dermatitis herpetiformis is a chronic rash that can occur and reoccur over a long period of time. The rash can be extremely itchy and it may cause bumps and blisters. While antibiotics and diet alterations can help, dermatitis herpetiformis can be debilitating for a long time. This disorder is so serious that if it is not treated right away it can cause intestinal cancer. At this time, there is no known prevention. It is believed that people with sensitivity to gluten run a higher risk of acquiring the disorder. It may lead to thyroid disease.

Eligibility

Simply being diagnosed with one of these disorders such as dermatitis herpetiformis does not qualify you for disability insurance. The Social Security Administration takes many things into consideration when they review a claim. Again, how the disorder affects someone's life may determine the extent of the disability. How severe are the skin lesions? How frequent are the attacks or flare-ups? How debilitating and consistent are the treatments? How much do the symptoms affect the claimant's life? These are some of the issues that will be considered.

Filing a Disability Claim

If you have been diagnosed with one of these skin disorders, you may be eligible for disability insurance. Most claims are denied initially. So, it becomes increasingly important to have an experienced disability lawyer on your side to ensure success with your claim. Eventually you may have to have a hearing with an administrative law judge to determine your eligibility. Having a disability attorney can help you through the process.
