SSDI for Fibromyalgia

Fibromyalgia is a disorder that is identified with pervasive severe pain. Typically, the symptoms include widespread extreme pain of the muscles, tendons, and ligaments, debilitating and overwhelming fatigue, extensive bowel disorder, Allodynia (painful sensitivity to gentle touch), and sore spots throughout the body that can reach the extremities, back, neck, shoulders, and hips. Other symptoms can include tingling sensation on the skin, extended and lingering muscle spasms, weakness of the limbs, and chronic muscle and nerve pain. Fibromyalgia is also linked to a chronic sleep disorder known as Alpha-Delta Sleep Disorder. This disorder disrupts the frequencies at which the brain emits Alpha and Delta brain waves when a person is asleep. This disruption prevents the victim from reaching deep sleep or from maintaining it long enough to achieve the regenerative and healing properties associated with deep sleep. Fibromyalgia is more frequent among women but men and children can suffer from this disease as well. Fibromyalgia affects one in fifty Americans.

The Federal Insurance Contributions Act (FICA) tax funds the Social Security Disability Insurance (SSDI). SSDI is intended to offer financial assistance to Americans who suffer a disability and are unable to work. The Social Security Administration (SSA) provides this program as a social insurance to afford financial assistance to persons who are retired, disabled, and survivors of qualified individuals. To be eligible for SSDI a person must have previously worked in the U.S. and paid taxes into FICA. A laborer must have earned sufficient SSDI credits through his/her taxable earnings to qualify for SSDI benefits. Disability benefits are payable to blind or disabled workers, widow/widower, or eligible adults that have been disabled since childhood. The amount of the monthly benefits depends on the Social Security earnings record of the worker. Adult children of eligible persons may also qualify for SSDI benefits on their parent’s earnings record if he/she becomes disabled before the age of 22.

The National Institute of Arthritis and Musculoskeletal and Skin Diseases (NIAMS), lists the following as typical symptoms of Fibromyalgia:

  • Severe Sleep Disorders
  • Agonizing Menstrual Cycles
  • Constant and Severe Headaches
  • Chronic Depression and Anxiety
  • Rigidity and Soreness (especially in the morning)
  • Cognitive Dysfunctions (clouded thoughts or loss of memory)
  • Numbness or Tingling (extremities, neck, back, and shoulders)

People that suffer from Fibromyalgia can qualify for SSDI because of the intensity of the symptoms. The symptoms vary widely but never completely dissipate. The causes or triggers of Fibromyalgia are unknown although the disorder has been widely recorded and linked to certain conditions. Research has proven that certain diseases and recurring injuries can lead to Fibromyalgia. People with Rheumatoid Arthritis, Lupus, and Ankylosing Spondylitis (Arthritis of the Spine) are more susceptible of developing this disorder. The disorder has even been recorded as the result of an automobile accident or after a traumatic event. Other names for Fibromyalgia include Tension Myalgias, Fibrositis Chronic Muscle Pain Syndrome, and Psychogenic Rheumatism.

Normally, in order to be eligible for SSDI benefits, an applicant must meet two different earnings requirement tests:

  • The Recent Work Test - This test is based on your age at the time you became disabled
  • The Duration of Work Test - This test is to demonstrate that you worked long enough under Social Security
